1. 條款接受
存取及使用 FoodShot AI，即表示您接受並同意受本協議條款及條件之約束。
2. 使用授權
2.1 Using the service
Subject to these terms, we grant you a limited, non-exclusive, non-transferable and revocable license to access and use FoodShot AI, on the website and in our apps, for your personal or business purposes. The FoodShot AI software, website, style library, templates and branding remain ours; this license does not transfer title to them, and you may not copy, resell or sublicense the service itself.
2.2 Photos you upload
You keep whatever rights you have in the photos and other material you upload ("Your Content"). You confirm that you own Your Content or have permission to use it in this way. You grant us a limited license to store, process and transform Your Content only as needed to provide, secure and support the service for you. If you mark an image as public where the service offers that option, you also allow us to display it inside FoodShot AI until you make it private or delete it.
2.3 Images you create
As long as you comply with these terms and have paid any fees that apply, you may use the images you create with FoodShot AI ("Outputs") for any lawful personal or commercial purpose, including menus, delivery-app listings, websites, social media, advertising and print, without crediting FoodShot AI. We do not claim ownership of your Outputs.
Outputs are created by AI models, so other users may receive similar images, and we cannot guarantee that an Output is protected by copyright or free of third-party rights in every country. You are responsible for how you use your Outputs, including making sure they fairly represent the food and products you sell and that they meet the rules of any platform where you publish them.
3. 使用者帳戶
您有責任維護帳戶及密碼之機密性。您同意對您帳戶下發生的所有活動承擔責任。
4. 禁止用途
您不得將本服務用於任何非法或未經授權之目的，亦不得在使用本服務時違反您所在司法管轄區之任何法律。
5. 內容
本服務允許您發布、連結、儲存、分享及以其他方式提供特定資訊、文字、圖形、影片或其他素材。您須對您發布至本服務之內容負責。
6. 付款、訂閱與退款
6.1 費用如何收取
In our mobile apps, FoodShot AI is sold through the app stores. On Android every purchase is processed by Google Play, and on iOS by the Apple App Store. We never receive or store your card details — for these transactions the store is the merchant of record. Purchases made on foodshot.ai are covered in section 6.8.
- 訂閱（FoodShot Pro） — 按週或按年計費，在您取消前將自動續訂。
- 點數包 — 一次性購買的圖片生成點數，依使用情形消耗。
價格會在您確認前於購買畫面以當地貨幣顯示。您所看到的金額即為實際收取的總額，已包含適用的各項稅金（含加值稅或消費稅）。
6.2 免費試用與自動續訂
若提供免費試用，其期間與試用後適用的價格會在您訂閱前顯示於購買畫面。除非您在試用結束前至少 24 小時取消，否則將自動轉為該價格的付費訂閱，並在您取消前於每個計費週期結束時自動續訂。
6.3 如何取消
您可以隨時取消，且無需與我們聯絡：
- 在應用程式中 — 開啟「設定」並點選「管理訂閱」，即可直接前往您的訂閱頁面。
- 在 Android 上 — Google Play →「付款和訂閱」→「訂閱」。
- 在 iOS 上 — 設定 → 您的名稱 → 訂閱。
取消後將停止後續續訂。除非您所在地區的法律另有規定，您仍可使用 Pro 直到已付費期間結束，之後不再續訂。
6.4 於期間中途終止訂閱
若您所在地區的法律賦予您在計費週期中途終止訂閱並就未使用部分取得退款的權利，該權利即適用，我們也會予以遵守。由於付款由應用程式商店處理，請將購買收據以電子郵件寄至 hello@foodshot.ai，我們將透過應用程式商店為剩餘天數安排按比例退款。
6.5 解約權（審閱期）
若您是所在國家就數位商品購買賦予法定審閱期的消費者——例如歐盟、歐洲經濟區與英國為 14 天，韓國為 7 天——您可於該期間內將購買收據以電子郵件寄至 hello@foodshot.ai 撤回購買。
請注意數位內容的一般例外：一旦依您的要求開始提供且您已開始使用所購買的內容，解約權即不再涵蓋您已使用的部分。實務上，已用於生成圖片的點數無法撤回，而未使用的點數與未使用的訂閱期間則可以。
6.6 退款
在 Google Play，您可於購買後 48 小時內自行申請退款。超過 48 小時後，Google 會將退款要求轉由我們處理：請將訂單編號以電子郵件寄至 hello@foodshot.ai，我們將進行審核，若符合退款條件則透過 Google Play 退款。Apple App Store 的退款由 Apple 於 reportaproblem.apple.com 處理，但若您先與我們聯絡，我們也很樂意協助。
除上述法定權利外，若因我方問題導致生成失敗，我們會自動退還點數，您無需提出申請。已成功生成圖片所使用的點數則不予退款，因為服務已提供完成。
6.7 付款確認與價格變更
您的購買由應用程式商店確認，商店會以電子郵件寄送收據並將該交易列入您的商店帳戶。商店確認付款後，應用程式內的點數餘額與 Pro 狀態會隨即更新。若我們調整您已持有訂閱的價格，將事先通知您，您可在新價格生效前取消。
6.8 Purchases on foodshot.ai
Plans bought on foodshot.ai are billed monthly or yearly through our payment processor, Stripe, using the payment methods shown at checkout, and renew automatically until you cancel. The price and the number of credits included are shown before you confirm. Credits do not roll over to the next month. You can cancel at any time from Settings by choosing Manage subscription, which opens your Stripe billing portal; your plan stays active until the end of the period you have paid for. If you have not used any credits in your current billing period, you can ask for a full refund within 7 days of payment by emailing hello@foodshot.ai. Your statutory rights described in sections 6.4 and 6.5 also apply to web purchases.
7. 隱私權
您對 FoodShot AI 的使用亦受我們的隱私權政策規範。請詳閱我們的隱私權政策，該政策亦規範本網站之運作，並告知使用者我們的資料蒐集實務。
8. 終止
我們得以自行裁量，基於任何理由，在不事先通知或不承擔任何責任之情況下，立即終止或暫停您的帳戶並禁止您存取本服務。
9. 免責聲明
FoodShot AI 上之資訊係以「現況」提供。在法律允許之最大範圍內，FoodShot AI 不作任何明示或默示之保證。
10. 責任限制
在任何情況下，FoodShot AI 或其供應商均不對因使用或無法使用 FoodShot AI 上之資料所產生的任何損害承擔責任。
11. 準據法
本條款及條件受美國法律管轄並依其解釋，且您不可撤銷地服從該州或該地區法院之專屬管轄權。
