Welcome to Foodshot Ai ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, installing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Changes to Terms

We may modify these Terms at any time. We'll post the updated Terms with a new "Last updated" date and, for material changes, provide notice via email or in-app. Continued use after changes constitutes acceptance.

3. Definitions

  • "User Content" means all content you upload or generate through the Service, including photographs, AI‑generated images, text, and metadata.
  • "Subscriptions" means the auto‑renewable subscription products you purchase through the Company or our third‑party provider (e.g., RevenueCat).
  • "Transformations" means the AI‑powered editing and improvement processes applied to your images.

4. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract. You are responsible for all activity under your account. Keep your password secure, and notify us immediately of any unauthorized use.

5. User Content; License Grant

  1. Your Rights: You retain all rights in your User Content. You represent and warrant you have the rights and permissions to upload and process that content.
  2. License to Company: By uploading or generating User Content, you grant us a worldwide, royalty‑free, sublicensable, transferable license to host, store, use, copy, modify, create derivative works of, and display that content solely to operate and improve the Service. This includes temporarily storing generated image URLs associated with your anonymous account for features like "Recently Generated", as further detailed in our Privacy Policy.
  3. Disclaimer of Liability: We do not review User Content in advance. We are not responsible for any claims arising from your content (including AI‑generated images of real brands, trademarks, or copyrighted materials). You agree to defend, indemnify, and hold us harmless from all claims arising from your User Content.

6. Prohibited Conduct

You agree not to:

  • Upload illegal, infringing, defamatory, or harmful content.
  • Violate any intellectual property or privacy rights.
  • Use the Service to create realistic AI images that infringe third‑party trademarks, copyrights, or rights of publicity.
  • Attempt to reverse engineer, interfere with, or subvert the Service.

7. Subscription and Payment

  1. Billing: Subscriptions are billed in advance on a recurring basis (monthly or yearly) as selected at purchase.
  2. Provider: Payments are processed through our third‑party provider (e.g., RevenueCat).
  3. Cancellation & Refunds: You may cancel anytime; cancellations take effect at the end of the current billing period. We do not offer refunds for partial periods, except as required by law.

8. Free and Trial Plans

We may offer free or trial subscriptions. Upon expiration, your access will downgrade automatically unless you convert to a paid plan.

9. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are owned by the Company or our licensors. You may not copy, modify, distribute, or create derivative works of our code, trademarks, or documentation.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to defend and indemnify the Company and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from (a) your User Content, (b) your breach of these Terms, or (c) your violation of any law or third‑party right.

13. Governing Law; Dispute Resolution

These Terms are governed by the laws of Turkey, without regard to conflict‑of‑law principles. You agree to exclusive jurisdiction and venue in the courts located in Istanbul, Turkey.

14. Termination

We may suspend or terminate your access for any reason, including breach of these Terms. Upon termination, all licenses granted to you will immediately cease.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement.
  • Severability: If any provision is unenforceable, the remainder will remain in full force.
  • Waiver: Failure to enforce any right is not a waiver.
